- Subject: Regulation Amending the Regulation on Control of Industrial Air Pollution

- The Regulation on Control of Industrial Air Pollution, published in the Official Gazette dated 03.07.2009 and numbered 27277 (the “Regulation”) has been revised by the Regulation Amending the Regulation on Control of Industrial Air Pollution, published in the Official Gazette dated 06.11.2020 and numbered 31296. To that effect;
- The following provisional article has been added to the Regulation:
- “Transitional provision
- PROVISIONAL ARTICLE 8 – (1) The Regulation establishing this article and the provisions stated under the “EE) TWENTY EIGHT GROUP FACILITIES: Geothermal Power Generation Facilities” heading added to ANNEX-5 shall be applied as of 30.06.2021.”
- ARTICLE 2 – The following part has been added to ANNEX-5 of the same Regulation.
- “EE) TWENTY EIGHT GROUP FACILITIES: Geothermal Power Generation Facilities
- (1) In geothermal power plants, H2S emission cannot be emitted more than the values given below. The limit value stated in Table 1.2.1 in Annex-1 is not applied in this regard.

- (2) Provisions regarding the chimney height, flue velocity and vertical outlet condition in this Regulation are not required for geothermal power plants.”
- Special Emission Limits for High Polluting Facilities are determined in Annex-5 of the Regulation. The Geothermal Power Generation Facilities with the “EE) Twenty Eight Group Facilities” heading has been added among the categories stated in the Annex. As a result, as of 30.06.2021, the amount of H2S emissions that geothermal power generation facilities can emit according to their Megawatt generation capacity has been limited. Furthermore, it has been indicated that the chimney height, flue velocity and vertical outlet condition stated in the Regulation shall not be required for geothermal power plants.
- The Regulation amending the Regulation has been put into force as of its publication (06.11.2020).
