• Subject: Communique regarding the Administrative Monetary Fines to be Imposed pursuant to Subparagraph (k) of Paragraph One of Article 20 of the Environmental Law Numbered 2872

  • The Communique regarding the Administrative Monetary Fines to be Imposed pursuant to Subparagraph (k) of Paragraph One of Article 20 of the Environmental Law Numbered 2872 (the “Law”) (the “Communique”) was published in the Repeated Official Gazette (5th Repeated Gazette) dated 31.12.2020 and numbered 31351 and entered into force.
  • INTRODUCTION
  • Under Article 20 of the Law, the monetary fines to be imposed in case of violation of the Law have been stated. 
  • COMMUNIQUE
  • It has been stated in the Communique that the number of monetary fines specified in subparagraph (k) of paragraph one of Article 20 of the Law, excluding those related to special environmental protection zones, between 01.01.2021 and 31.12.2021 shall be applied as follows: the administrative monetary fine in the amount of 20.000,00.-TRY is increased to 80,465.00.-TRYthe administrative monetary fine in the amount of 100.000,00.-TRY is increased to 402.385,00.-TRY.
  • According to this; the matters regulating the circumstances where the administrative monetary fines in Article 20 of the Law will be imposed are as 
  • follows:
  • – To those who destroy biological diversity in violation of the matter specified in subparagraph (a) of Article 9 with the “Protection of Environment” of the Law;
  • –  To those who violate the principles and prohibitions specified in the Regulation for wetlands as per subparagraph (e) of Article 9 with the “Protection of Environment” heading of the Law; 
  • –  To those who violate the principles and prohibitions specified in subparagraph (f) of Article 9 with the “Protection of Environment” heading of the Law; the administrative monetary fine in the amount of 80.465,00-TRY shall be imposed;
  • –  To those who violate the subparagraph one of paragraph (e) of Article 9 with the “Protection of Environment” heading of the Law; the administrative monetary fine in the amount of 402.385,00-TRY shall be imposed.
