Kirac\u0131n\u0131n tacir oldu\u011fu ve kiralanan yerin i\u015f yeri oldu\u011fu kira ili\u015fkilerini inceleyen dokuz madde h\u00fckm\u00fcn\u00fcn y\u00fcr\u00fcrl\u00fck tarihi 1 Temmuz 2020 tarihine kadar ertelenmi\u015ftir.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Kanun h\u00fck\u00fcmleri uyar\u0131nca, kira ili\u015fkisini d\u00fczenleyen maddeler kirac\u0131y\u0131 koruma yakla\u015f\u0131m\u0131 bar\u0131nd\u0131rmaktad\u0131r. Kanun, kira s\u00f6zle\u015fmesi \u00e7er\u00e7evesinde kiralayan\u0131n daha g\u00fc\u00e7l\u00fc konumda oldu\u011funu kabul eder ve kirac\u0131y\u0131 korumak ad\u0131na nisbi emredici h\u00fck\u00fcmlere yer vererek, dengeyi korumay\u0131 ama\u00e7lar. Ancak kirac\u0131n\u0131n tacir oldu\u011fu kira s\u00f6zle\u015fmelerinde, kanun koyucu kirac\u0131n\u0131n yeterli finansal g\u00fcce sahip oldu\u011funu g\u00f6zetti\u011finden, herhangi bir taraf\u0131n nisbi emredici h\u00fck\u00fcmlerle daha fazla korunmamas\u0131 gerekti\u011fi kanaatine var\u0131lm\u0131\u015ft\u0131r.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Kanun\u2019da kirac\u0131lar\u0131 farkl\u0131 y\u00f6nlerden koruyan dokuz madde h\u00fckm\u00fcn\u00fcn (323, 325, 331, 340, 342, 343, 344, 346, 354) y\u00fcr\u00fcrl\u00fck tarihi 1 Temmuz 2020 tarihine kadar ertelenmi\u015ftir.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Bilgilendirme notumuzda; 1 Temmuz 2020 tarihinde kirac\u0131s\u0131n\u0131n tacir olarak say\u0131lan ki\u015filer ile \u00f6zel hukuk ve kamu hukuku t\u00fczel ki\u015fileri oldu\u011fu i\u015f yerleri i\u00e7in y\u00fcr\u00fcrl\u00fc\u011fe girecek olan h\u00fck\u00fcmler meydana gelecek farkl\u0131l\u0131klar incelenecektir.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li><b>K\u0130RA \u0130L\u0130\u015eK\u0130S\u0130N\u0130N DEVR\u0130 <i>(Kanun md. 323)<\/i><\/b><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Kanun\u2019un 323\u2019\u00fcnc\u00fc maddesi;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u2018<\/span><i><span style=\"font-weight: 400;\">\u2019Kirac\u0131, kiraya verenin yaz\u0131l\u0131 r\u0131zas\u0131n\u0131 almad\u0131k\u00e7a, kira ili\u015fkisini ba\u015fkas\u0131na devredemez. Kiraya veren, i\u015fyeri kiralar\u0131nda hakl\u0131 sebep olmad\u0131k\u00e7a bu r\u0131zay\u0131 vermekten ka\u00e7\u0131namaz. Kiraya verenin yaz\u0131l\u0131 r\u0131zas\u0131yla kira ili\u015fkisi kendisine devredilen ki\u015fi, kira s\u00f6zle\u015fmesinde kirac\u0131n\u0131n yerine ge\u00e7er ve devreden kirac\u0131, kiraya verene kar\u015f\u0131 bor\u00e7lar\u0131ndan kurtulur. \u0130\u015fyeri kiralar\u0131nda devreden kirac\u0131, kira s\u00f6zle\u015fmesinin bitimine kadar ve en fazla iki y\u0131l s\u00fcreyle devralanla birlikte m\u00fcteselsilen sorumlu olur.\u2019\u2019<\/span><\/i><span style=\"font-weight: 400;\"> \u015feklindedir.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Bu h\u00fck\u00fcmde kiraya vereni ilgilendiren k\u0131s\u0131m, kiraya verenin hakl\u0131 sebep olmad\u0131k\u00e7a kira ili\u015fkisinin devrine r\u0131za vermekten ka\u00e7\u0131n\u0131lamayaca\u011f\u0131d\u0131r.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Kanun h\u00fckm\u00fcnde, kiraya verenin yaz\u0131l\u0131 r\u0131zas\u0131yla kira ili\u015fkisi kendisine devredilen ki\u015fi kirac\u0131n\u0131n yerine ge\u00e7er ve devreden kirac\u0131, kiraya verene kar\u015f\u0131 bor\u00e7lar\u0131ndan kurtulur. Ancak; i\u015fyeri kiralar\u0131nda kira ili\u015fkisini devreden kirac\u0131, kira s\u00f6zle\u015fmesinin bitimine kadar ve en fazla iki y\u0131l s\u00fcreyle devralanla birlikte m\u00fcteselsilen sorumlu olmaktad\u0131r.<\/span><\/p>\n<p><b><i>Bu h\u00fckm\u00fcn y\u00fcr\u00fcrl\u00fc\u011fe girmesiyle birlikte i\u015f yeri kiralar\u0131nda kiraya veren, hakl\u0131 bir sebep olmad\u0131k\u00e7a kira s\u00f6zle\u015fmesinin devri i\u00e7in r\u0131za g\u00f6stermekten ka\u00e7\u0131namayacakt\u0131r.<\/i><\/b><\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li><b>K\u0130RA S\u00d6ZLE\u015eMES\u0130N\u0130N ERKEN FES\u0130H HAL\u0130 <i>(Kanun md. 325)<\/i><\/b><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Kanun\u2019un 325\u2019inci maddesi;<\/span><\/p>\n<p><i><span style=\"font-weight: 400;\">\u2018\u2019Kirac\u0131, s\u00f6zle\u015fme s\u00fcresine veya fesih d\u00f6nemine uymaks\u0131z\u0131n kiralanan\u0131 geri verdi\u011fi takdirde, kira s\u00f6zle\u015fmesinden do\u011fan bor\u00e7lar\u0131, kiralanan\u0131n benzer ko\u015fullarla kiraya verilebilece\u011fi makul bir s\u00fcre i\u00e7in devam eder. Kirac\u0131n\u0131n bu s\u00fcrenin ge\u00e7mesinden \u00f6nce kiraya verenden kabul etmesi beklenebilecek, \u00f6deme g\u00fcc\u00fcne sahip ve kira ili\u015fkisini devralmaya haz\u0131r yeni bir kirac\u0131 bulmas\u0131 h\u00e2linde, kirac\u0131n\u0131n kira s\u00f6zle\u015fmesinden do\u011fan bor\u00e7lar\u0131 sona erer. Kiraya veren, yapmaktan kurtuldu\u011fu giderler ile kiralanan\u0131 ba\u015fka bi\u00e7imde kullanmakla elde etti\u011fi veya elde etmekten kasten ka\u00e7\u0131nd\u0131\u011f\u0131 yararlar\u0131 kira bedelinden indirmekle y\u00fck\u00fcml\u00fcd\u00fcr.\u2019\u2019<\/span><\/i><span style=\"font-weight: 400;\"> \u015feklindedir.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Bu madde h\u00fckm\u00fc, kirac\u0131n\u0131n kira s\u00f6zle\u015fmesinde yer alan tarihten \u00f6nce s\u00f6zle\u015fmeyi feshetmesi halinde, kira s\u00f6zle\u015fmesinin kiralan\u0131n benzer ko\u015fullarla kiraya verilebilece\u011fi makul bir s\u00fcre i\u00e7in daha devam edece\u011fini ifade etmektedir. Ayr\u0131ca kirac\u0131n\u0131n ayn\u0131 ko\u015fullarla yeni bir kirac\u0131 bulmu\u015f olmas\u0131 hali de, kirac\u0131n\u0131n bor\u00e7lar\u0131n\u0131 sona erdirmektedir.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Erken fesih halinde;<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Kirac\u0131n\u0131n, kira s\u00f6zle\u015fmesinden do\u011fan bor\u00e7lar\u0131 kiralanan\u0131n benzer ko\u015fullarla kiraya verilebilece\u011fi makul bir s\u00fcre i\u00e7in devam edecektir.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Kirac\u0131n\u0131n yerine buldu\u011fu yeni kirac\u0131n\u0131n \u00f6deme g\u00fcc\u00fcne sahip ve kira ili\u015fkisini devralmaya haz\u0131r olmas\u0131 gerekmektedir.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Kiraya veren, yapmaktan kurtuldu\u011fu giderler ile kiralanan\u0131 ba\u015fka bi\u00e7imde kullanmakla elde etti\u011fi veya elde etmekten kasten ka\u00e7\u0131nd\u0131\u011f\u0131 yararlar\u0131 kira bedelinden mahsup edecektir.<\/span><\/li>\n<\/ol>\n<p><b><i>Kiralanan\u0131n erken tahliyesi halinde kural olarak kirac\u0131, kira s\u00fcresinin sonuna kadarki kira bedelinden sorumludur. Ancak; bu h\u00fck\u00fcm ile kirac\u0131n\u0131n y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc s\u0131n\u0131rland\u0131r\u0131lm\u0131\u015ft\u0131r. 1 Temmuz 2020 tarihi itibariyle, kirac\u0131 erken fesih durumunda Kanun h\u00fckm\u00fcndeki \u015fartlar alt\u0131nda yeni kirac\u0131 bularak makul s\u00fcre i\u00e7in \u00f6ng\u00f6r\u00fclen kira miktar\u0131n\u0131 \u00f6dememe hakk\u0131ndan yararlanabilecektir.<\/i><\/b><\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li><b>K\u0130RA S\u00d6ZLE\u015eMES\u0130N\u0130N OLA\u011eAN\u00dcST\u00dc FES\u0130H HAL\u0130 <i>(Kanun md. 331)<\/i><\/b><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Kanun\u2019un 331\u2019inci maddesi;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u2018<\/span><i><span style=\"font-weight: 400;\">\u2019Taraflardan her biri, kira ili\u015fkisinin devam\u0131n\u0131 kendisi i\u00e7in \u00e7ekilmez h\u00e2le getiren \u00f6nemli sebeplerin varl\u0131\u011f\u0131 durumunda, s\u00f6zle\u015fmeyi yasal fesih bildirim s\u00fcresine uyarak her zaman feshedebilir. H\u00e2kim, durum ve ko\u015fullar\u0131 g\u00f6z \u00f6n\u00fcnde tutarak, ola\u011fan\u00fcst\u00fc fesih bildiriminin parasal sonu\u00e7lar\u0131n\u0131 karara ba\u011flar.\u2019\u2019 <\/span><\/i><span style=\"font-weight: 400;\">\u015feklindedir.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Kira s\u00f6zle\u015fmesinin devam\u0131n\u0131n taraflarca beklenemeyecek durumda olmas\u0131 halinde ola\u011fan\u00fcst\u00fc fesih h\u00fckm\u00fcne dayal\u0131 olarak kira ili\u015fkisinin sonland\u0131r\u0131lmas\u0131 s\u00f6z konusudur.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">M\u00fclga 808 say\u0131l\u0131 Bor\u00e7lar Kanunu\u2019nun (\u2018\u2019<\/span><b>eBK\u2019<\/b><span style=\"font-weight: 400;\">\u2019), 264\u2019\u00fcnc\u00fc maddesinde kira s\u00f6zle\u015fmesinin kirac\u0131 taraf\u0131ndan ola\u011fan\u00fcst\u00fc sebeple feshi halinde, bu \u00f6nemli sebeplerin ispat edilmesi gerekti\u011fi ve her halde kirac\u0131n\u0131n en az 6 (alt\u0131) ayl\u0131k kira bedeli tutar\u0131nda tazminat \u00f6demesi gerekti\u011fi h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r. Yeni d\u00fczenlemede, Kanun h\u00fckm\u00fcn\u00fcn son c\u00fcmlesinde hakimlere tan\u0131nan hak; ola\u011fan\u00fcst\u00fc feshe dayal\u0131 tazminat davalar\u0131nda, tazminat miktar\u0131n\u0131n hakimlerce belirlenmesine ili\u015fkindir. Bu \u00e7er\u00e7evede, \u00f6denecek tazminat\u0131n miktar\u0131 hakimler taraf\u0131ndan belirlenecektir.<\/span><\/p>\n<p><b><i>Kanun h\u00fckm\u00fc uyar\u0131nca kira ili\u015fkisinin devam\u0131n\u0131 kendisi i\u00e7in \u00e7ekilmez hale getiren \u00f6nemli sebeplerin varl\u0131\u011f\u0131 durumunda; yasal fesih bildirim s\u00fcresinde (her 6 ayl\u0131k d\u00f6nem sonu i\u00e7in en az 3 ay \u00f6nce bildirim yap\u0131lmas\u0131 suretiyle) kira s\u00f6zle\u015fmesinin feshedilebilece\u011fi belirtilmi\u015ftir. Bu h\u00fck\u00fcm de, 1 Temmuz 2020 tarihi itibariyle y\u00fcr\u00fcrl\u00fc\u011fe girecektir.<\/i><\/b><\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li><b>BA\u011eLANTILI S\u00d6ZLE\u015eME <i>(Kanun md. 340)<\/i><\/b><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Kanun\u2019un 331\u2019inci maddesi;<\/span><\/p>\n<p><i><span style=\"font-weight: 400;\">\u2018\u2019Konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda s\u00f6zle\u015fmenin kurulmas\u0131 ya da s\u00fcrd\u00fcr\u00fclmesi, kirac\u0131n\u0131n yarar\u0131 olmaks\u0131z\u0131n, kiralanan\u0131n kullan\u0131m\u0131yla do\u011frudan ili\u015fkisi olmayan bir bor\u00e7 alt\u0131na girmesine ba\u011flanm\u0131\u015fsa, kirayla ba\u011flant\u0131l\u0131 s\u00f6zle\u015fme ge\u00e7ersizdir.\u2019\u2019<\/span><\/i><span style=\"font-weight: 400;\"> \u015feklindedir.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Ba\u011flant\u0131l\u0131 s\u00f6zle\u015fme yasa\u011f\u0131 konut ve \u00e7at\u0131l\u0131 i\u015fyerleri i\u00e7in s\u00f6z konudur. Kirac\u0131n\u0131n yarar\u0131na olmayan veya kiralan\u0131n kullan\u0131m\u0131yla do\u011frudan ili\u015fkili olmayan s\u00f6zle\u015fmeler bu h\u00fck\u00fcm kapsam\u0131nda ge\u00e7ersiz say\u0131lacakt\u0131r. Ba\u011flant\u0131l\u0131 s\u00f6zle\u015fmeler kira s\u00f6zle\u015fmesine ek bir protokol ile yap\u0131laca\u011f\u0131 gibi, ayr\u0131 bir s\u00f6zle\u015fme \u015feklinde de taraflar\u0131 bor\u00e7 alt\u0131na sokabilmektedir.<\/span><\/p>\n<p><b><i>Kirac\u0131n\u0131n aleyhine durum te\u015fkil edecek, kirac\u0131y\u0131 bor\u00e7 alt\u0131na sokan ba\u011flant\u0131l\u0131 s\u00f6zle\u015fme halleri bu h\u00fck\u00fcm ile ge\u00e7ersiz say\u0131lm\u0131\u015ft\u0131r.<\/i><\/b><\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li><b>K\u0130RACININ G\u00dcVENCE VERMES\u0130 (DEPOZ\u0130TO)<i> (Kanun md. 342)<\/i><\/b><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Kanun\u2019un 342\u2019nci maddesi;<\/span><\/p>\n<p><i><span style=\"font-weight: 400;\">\u2018\u2019Konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda s\u00f6zle\u015fmeyle kirac\u0131ya g\u00fcvence verme borcu getirilmi\u015fse, bu g\u00fcvence \u00fc\u00e7 ayl\u0131k kira bedelini a\u015famaz. G\u00fcvence olarak para veya k\u0131ymetli evrak verilmesi kararla\u015ft\u0131r\u0131lm\u0131\u015fsa kirac\u0131, kiraya verenin onay\u0131 olmaks\u0131z\u0131n \u00e7ekilmemek \u00fczere, paray\u0131 vadeli bir tasarruf hesab\u0131na yat\u0131r\u0131r, k\u0131ymetli evrak\u0131 ise bir bankaya depo eder. Banka, g\u00fcvenceleri ancak iki taraf\u0131n r\u0131zas\u0131yla veya icra takibinin kesinle\u015fmesiyle ya da kesinle\u015fmi\u015f mahkeme karar\u0131na dayanarak geri verebilir. Kiraya veren, kira s\u00f6zle\u015fmesinin sona ermesini izleyen \u00fc\u00e7 ay i\u00e7inde kirac\u0131ya kar\u015f\u0131 kira s\u00f6zle\u015fmesiyle ilgili bir dava a\u00e7t\u0131\u011f\u0131n\u0131 veya icra ya da iflas yoluyla takibe giri\u015fti\u011fini bankaya yaz\u0131l\u0131 olarak bildirmemi\u015fse banka, kirac\u0131n\u0131n istemi \u00fczerine g\u00fcvenceyi geri vermekle y\u00fck\u00fcml\u00fcd\u00fcr.\u2019\u2019<\/span><\/i> <span style=\"font-weight: 400;\">\u015feklindedir.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">S\u00f6z konusu h\u00fck\u00fcmde kirac\u0131n\u0131n g\u00fcvence (depozito) vermesi kararla\u015ft\u0131r\u0131lm\u0131\u015fsa, verece\u011fi depozitonun 3 ayl\u0131k kira bedelini a\u015famayaca\u011f\u0131 belirtilerek, depozito i\u00e7in \u00fcst s\u0131n\u0131rland\u0131rma yap\u0131lm\u0131\u015ft\u0131r.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">H\u00fckm\u00fcn devam\u0131nda, g\u00fcvence bedelinin para veya k\u0131ymetli evrak verilmesi kararla\u015ft\u0131r\u0131lm\u0131\u015fsa kirac\u0131n\u0131n, kiraya verenin onay\u0131 olmaks\u0131z\u0131n \u00e7ekilmemek \u00fczere, paray\u0131 vadeli bir tasarruf hesab\u0131na yat\u0131raca\u011f\u0131, k\u0131ymetli evrak\u0131 ise bir bankaya depo edece\u011fi h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Son olarak g\u00fcvencelerin iadesi halinde, bankan\u0131n, g\u00fcvenceleri ancak iki taraf\u0131n r\u0131zas\u0131yla veya icra takibinin kesinle\u015fmesiyle ya da kesinle\u015fmi\u015f mahkeme karar\u0131na dayanarak geri verebilece\u011fi ifade edilmi\u015ftir.<\/span><\/p>\n<p><b><i>Kanun h\u00fckm\u00fc uyar\u0131nca g\u00fcvence bedeli miktar olarak \u00fc\u00e7 ayl\u0131k kira bedeliyle s\u0131n\u0131rlanm\u0131\u015f ve bunlar\u0131n para veya k\u0131ymetli evrak olmas\u0131 halinde bankaya yat\u0131r\u0131lmas\u0131 zorunlu hale getirilmi\u015ftir. Mevcut durumda taraflar s\u00f6zle\u015fme \u00f6zg\u00fcrl\u00fc\u011f\u00fc \u00e7er\u00e7evesinde g\u00fcvence bedelini \u00f6zg\u00fcrce belirleyebilmektedir. H\u00fckm\u00fcn y\u00fcr\u00fcrl\u00fc\u011fe girmesi ile birlikte g\u00fcvence bedeli miktar olarak s\u0131n\u0131rlanacakt\u0131r.
