{"id":1190,"date":"2020-11-18T13:52:30","date_gmt":"2020-11-18T10:52:30","guid":{"rendered":"https:\/\/www.narterlaw.com\/cevre-izin-ve-lisans-yonetmeliginde-degisiklikler\/"},"modified":"2022-06-07T11:28:10","modified_gmt":"2022-06-07T08:28:10","slug":"regulation-amending-the-environmental-permit-and-license-regulation","status":"publish","type":"post","link":"https:\/\/www.narterlaw.com\/en\/regulation-amending-the-environmental-permit-and-license-regulation\/","title":{"rendered":"Regulation Amending the Environmental Permit and License Regulation"},"content":{"rendered":"<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Subject<\/b><span style=\"font-weight: 400;\">: The Regulation Amending the Environmental Permit and License Regulation<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Date:<\/b><span style=\"font-weight: 400;\">\u00a006\/11\/2020<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Environmental Permit and License Regulation, published in the Official Gazette dated 10.09.2014 and numbered 29115 (the &#8220;<\/span><b>Regulation<\/b><span style=\"font-weight: 400;\">&#8220;) has been revised by the Regulation Amending the Environmental Permit and License Regulation, published in the Official Gazette dated 06.11.2020 and numbered 31296.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The purpose of the Regulation is to clarify the processes and procedures to be used in certificate, permit and license applications. The other purpose of the Regulation is to provide a more consistent, practical and clear implementation to address issues that previously caused delays in the implementation of projects and also caused financial losses for project investors and operators.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>With the Regulation Amending the Environmental Permit and License Regulation, the following provisional article has been added to the Regulation:<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><i><span style=\"font-weight: 400;\">\u201c<\/span><\/i><b><i>Transitional provision<\/i><\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b><i>PROVISIONAL ARTICLE 3 \u2013<\/i><\/b><i><span style=\"font-weight: 400;\"> (1) The provisions of this Regulation shall be applied as of 30.06.2021 for Article 1.7 added to the list in Annex-2 and the Regulation establishing this article.\u201d<\/span><\/i><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b><i>ARTICLE 2 \u2013<\/i><\/b><i><span style=\"font-weight: 400;\"> To the part with &#8220;1st Energy Industry&#8221; heading of Annex-2 of the same Regulation the following article has been added to be stated after Article 1.6.<\/span><\/i><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><i><span style=\"font-weight: 400;\">\u201c1.7 Geothermal power generation facilities with an installed capacity of 5MWe or above.\u201d<\/span><\/i><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b><i>\u00a0ARTICLE 3 &#8211;<\/i><\/b><i><span style=\"font-weight: 400;\"> This Regulation shall enter into force on the date of its publication.<\/span><\/i><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b><i>ARTICLE 4\u2013 <\/i><\/b><i><span style=\"font-weight: 400;\">(1) The provisions of this Regulation are enforced by the Minister of Environment and Urbanization.<\/span><\/i><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Article 1 in ANNEX-2 of the Regulation; limits enterprises which have a polluting impact on the environment under the &#8220;Energy Industry&#8221; heading. &#8220;Geothermal power generation facilities with an installed capacity of 5MWe or above&#8221; phrase has been added to this article with Article 1.7.
